Michigan Legislature Defers to Voter Referendum on Recreational Use of Marijuana

The deadline has come and gone for the Michigan legislature to pass the November 7, 2018 ballot initiative that would pave the way for legal recreational marijuana use in Michigan.

The Republican legislature had promoted the idea of legislatively passing the proposed referendum slated to be on the November ballot as a means to amend its legislation at a later date to suit its own interests and as a means to deter a greater Democratic turnout by eliminating the proposal to legalize recreational use of marijuana from the ballot under the perception that its presence might stimulate voter turnout of more Democrats than Republicans.

The ballot proposal will now be on Michigan’s November ballot and if passed would provide those age 21 and above to possess up to 2.5 ounces of marijuana outside their home and grow up to 12 plants within their home.

A 10 percent excise tax would be imposed on retail sales in addition to Michigan’s existing 6 percent sales tax.
